White House won't oppose new challenge to 2010 healthcare law

WASHINGTON (Reuters) - The Obama administration on Wednesday cleared the way for the U.S. Supreme Court to revive a lawsuit that challenges the 2010 healthcare overhaul on religious grounds, including a claim that it helps fund abortions.

Liberty University, a Christian college in Lynchburg, Virginia, had challenged the individual mandate, which required Americans to obtain insurance by 2014 or pay a penalty, and a mandate requiring big employers to provide coverage for workers.

The school has said the law violates the First Amendment ban on the government's establishing or impeding the free exercise of religion, by forcing objecting purchasers to buy insurance that could subsidize abortion, and exempting some religions from the law.

It has also said the law violates the U.S. Constitution's equal protection guarantee, and exceeds Congress' power to tax and spend and to regulate commerce.

In September 2011, the 4th U.S. Circuit Court of Appeals in Richmond, Virginia said it lacked jurisdiction over Liberty's case because the federal Anti-Injunction Act banned lawsuits seeking to halt collection of a tax.

The Supreme Court concluded otherwise when it upheld the individual mandate in a 5-4 vote on June 28. Liberty then argued it deserved another chance to litigate because the 4th Circuit decision, which the Supreme Court did not review, was wrong.

In Wednesday's filing, Solicitor General Donald Verrilli said Liberty's First Amendment and equal protection claims lack merit, but that the 4th Circuit never considered their merits.

"Under the circumstances of this case, (the government defendants) do not oppose further proceedings in the court of appeals to resolve them," he wrote.

Mathew Staver, a lawyer for Liberty, said in a phone interview: "We're very pleased with the Department of Justice's response, which we expected and which reflects the correct process that this case should follow."

The case is Liberty University et al v. Geithner et al, U.S. Supreme Court, No. 11-438.

23 die at Saudi wedding after gunfire downs cable

RIYADH -- Celebratory gunfire at a wedding party in eastern Saudi Arabia Tuesday night brought down an electric cable, killing 23 people, a local civil defense official said.?

"At the wedding, the cable fell on a metal door and the 23 people who died were all electrocuted," Eastern Province official Abdullah Khashman said by phone.?

However, the?al-Jazeera news organization cited local media reports that some of the casualties died as a result of a fire caused by the downed cable. The local reports said the dead were women and children.

A photograph of the aftermath of the accident, published on local newspapers' websites, showed a large courtyard strewn with fallen chairs and a pole in the middle supporting cables carrying lightbulbs.?

All those killed were from the same tribe, Khashman said. Thirty others were injured in the incident near Abqaiq, a center of the Saudi energy industry.?

Saudi Arabia banned the shooting of firearms at weddings, a popular tradition in tribal areas of the conservative Islamic kingdom, last month.?

Eastern Province governor Prince Mohammed bin Fahd ordered an investigation into the incident, the official Saudi Press Agency reported.?

Elmhurst Alderman Spreads the Word About Energy Efficiency ...

About a half-dozen Elmhurst residents with really old homes?the oldest built in 1889?gathered at 1st Ward Alderman Diane Gutenkauf's 1927 home last week to hear how they can save money on making their homes more energy efficient.

They learned that virtually every area single-family homeowner has been paying for years into a program for residential energy efficiency upgrades, and they are eligible to get that money back?and then some?to seal up and better insulate their homes. A relatively unknown program, available to all Nicor and ComEd customers, can provide the upgrades for a fraction of the cost of a hiring a contractor?and the home doesn't have to be anywhere near 100 years old to take advantage of the program.

Matt Elmore, a field organizer for Energy Impact Illinois, asked Gutenkauf to help get the word out by hosting the party. Energy Impact Illinois is a coalition led by the Chicago Metropolitan Agency for Planning in partnership ComEd, Nicor and other energy providers, along with several municipalities.

"The current marketplace is not connecting the dots between financial institutions, home and building owners, contractors and energy efficiency. There is unrealized economic value that could be captured by these groups if they acted in coordination.?? Energy Impact Illinois is a collaborative effort among its partners with the mission of helping residents, businesses and non-profits reduce energy use. The alliance provides simplified access to information, financial mechanisms and workforce resources that empower people to make their own energy impact."

The program is funding by the Federal American Recovery and Reinvestment Act and the US Department of Energy; $25 million in grants are available, just in the Chicago area, alone.

Visitors to Gutenkauf's home got to see where her old house leaks and learn about the program.

"It just seemed to me that this was a great thing to do, especially as an alderman, to help others find out about rebates. And, I live in an old house," Gutenkauf said.

Sealing a home for energy efficiency is not as simple as it seems. Homeowners in their zeal to make a home tight can overdo it. If the house isn't breathing correctly, carbon dioxide, carbon monoxide, chemicals, cleaners and mold become trapped in the house as contaminants. Even old homes can be sealed too tightly. That's why an energy assessment is critical.

"We all get pamphlets in our utility bills about how to save energy," Elmore said. "But it can get pretty technical. The only way to get specific and analyze a home's unique issues is through a program like this."

He passed around a sample ComEd bill, with a circle around the portion every customer pays into the energy efficiency program.

"Regulators found out that ComEd and Nicor had tens of millions of dollars in this fund and they weren't giving the money back as quickly as they would have liked," Elmore said. "It adds up to hundreds of dollars per homeowner over the last four or five years. It's really your money."

The Math

The focus for the upgrade is on air-sealing and insulation, Elmore said.

"Those are the lowest cost, most effective upgrades a homeowner can make to reduce utility bills and make their home more comfortable," he said.

On average, the improvements cost about $2,500, and that's for a full upgrade, he said.

The rebate is 70 percent of improvement cost, up to a maximum of $1,750. When you take that off the $2,500, the out of pocket expense is $750. Savings average $500 a year, so in a year and a half, the $750 investment pays for itself. (Return on investment for window replacement is something like 40 or 50 years; do it for looks, but not for real savings, Elmore said.)

The rebate is instant, right off the top, and there is no paperwork involved for the homeowner, Elmore said. The contractors that perform the work deal with the rebate paperwork on the back end; homeowners only have to cover the out-of-pocket cost. Some might say the out-of-pocket is a deal-breaker, but Elmore says zero interest loans also are a part of this government program.

"We offer 0 percent subsidized loans. They're normally 6 to 8 percent, and we will pay that so homeowners have 0 percent the first year," Elmore said.

The Process

The first step is a 2- to 3-hour energy assessment, which is followed by additional assessments by a program-approved contractor like Greg Galanos of Energy 360 Solutions in Wood Dale. Galanos demonstrated how he uses a blower device to measure how a home is "breathing," or the rate at which it replaces the inside air with outside air.

Gutenkauf's house was drawing 3,600 cubic feet of air per minute. A house the size of her's should be about 1,850 cubic feet, Galanos said.

"It's almost twice as leaky as the ideal," he said.

The contractor also will look at the attic, windows, electrical outlets, duct work, plumbing, lighting and "lots of little things," he said.

"When (home builders) drill holes from the attic to run outlets and light switches, they cut a 1-inch hold for a 1/2-inch piece of conduit, but they don't seal that up," Galanos said. "It you've got 20 of those, it really adds up. They're like little chimneys allowing heating dollars to escape."

He used an infrared device to measure air leaks around windows and doors. Gutenkauf's home has old, historic windows that are not efficient, but they can be improved without having to replace them.

Other Perks

One added benefit of having an energy audit is that any safety issues will be addressed first, like gas leaks from a furnace or appliance.

At the end of the assessment, the homeowner will receive a report that lists every upgrade that can be made, the cost, how much the rebate will cover and the return on investment. Homeowners can do as many or as few of the upgrades as they wish.

They also will get up to 10 free compact fluorescent bulbs, insulation for piping, furnace and hot water heater, and low-flow shower heads and faucet aerators as part of the initial assessment.

Once the upgrades are complete, if there is a 15 percent improvement in efficiency, the home will receive an Energy Star certificate which will be included on the home's listing on the Multiple Listing Service, increasing a home's value.?

  • Sign up for a $50 energy assessment by calling (855) 9-IMPACT. The $50 is waived if the homeowner hosts a house party.
  • Conservation Services Group, a nonprofit member of the Energy Impact Illinois alliance, completes the assessment and presents proposal with all possible energy efficiency upgrades to homeowner
  • If homeowner decides to move forward, a Building Performance Institute-certified contractor will come out and complete the work.

The program ends in mid-May so those interested should begin the process as soon as possible, Elmore said.

The small and medium business crowd has always been tough to figure out and for good reason. Unlike the companies they may compete against they often do not have the systems or support to do the many things that even they know would be good for their business.

One of the areas that is of particular concern is social media. There are many SMB?s who ?get? social media and are doing a tremendous job of leveraging the channel for their business. On the other hand there are many who simply are not. What seems to be a common thread, however, is the types of social media that the SMB set is most comfortable with.

I saw some liberals getting excited about this New York Times description of a nationwide health insurance plan that they cleverly tried to posit as the by-product of the public option.

The nationwide plans would get contracted out by the federal government and be available to consumers in the insurance exchanges. National plans, government-run? Sounds like a public option, right?

Well, no. Multi-state health plans will be made available to exchange recipients. But they will merely be contracted out by the federal government, and run by a private insurance company. This was devised as an admittedly weak substitute to the public option, and nobody who actually understands the Affordable Care Act is presuming that this is in any way the same deal.

These plans are not, however, actual public options. ?This is not government-sponsored, and it?s not a public plan,? says Tim Jost, a law professor at Washington and Lee University who focuses on health policy. ?These are plans that contract with the federal government.? [...]

No one at the time, however, thought the multi-state plan would work much like a public option at all. ?It?s not really similar at all,? says McDonough, now a professor at the Harvard University School of Public Health. ?It?s something that?s going to be more like one private plan choice.?

One of the two plan administrators has to technically be not-for-profit, but then again, so is Blue Cross. The plans look more like the Republican vision for the health insurance market, the sale of insurance policies ?across state lines,? more than anything. They may create ?competition? for the existing plans within an exchange by simply evading regulations under state laws. If the nationwide plans get enough subscribers, they may bargain providers down on rates, which could lower the cost of health care. But more likely, they would merely offer bare-bones insurance that doesn?t have to comply with the same requirements as other exchange participants. Therefore they will look like a good deal for consumers, while actually being junk insurance that doesn?t offer the same benefits as the other plans. The nationwide plans have some criteria, and the feds must sign off on some of their framework, but there?s ample room here for a nationwide provider to deliver fairly useless insurance at a low price and make a good profit.

The need to offer a substitute to placate those desiring a public option created this Frankenstein monster, which was admittedly not well thought-out. Those who did it ended up with the worst of all possible worlds; no public option supporter really even knew about these multi-state plans, and they have the potential to disrupt the exchanges and cause a race to the bottom.

As long as we?re in hurricane mode, I?ll quote George W. Bush by saying: ?Heckuva job.?

Mammoth storm Sandy plunges NYC into darkness

NEW YORK (AP) ? Much of New York was plunged into darkness Monday by a superstorm that overflowed the city's historic waterfront, flooded the financial district and subway tunnels and cut power to hundreds of thousands of people.

The city had shut its mass transit system, schools, the stock exchange and Broadway and ordered hundreds of thousands of New Yorkers to leave home to get out of the way of the superstorm Sandy as it zeroed in on the nation's largest city.

Residents spent much of the day trying to salvage normal routines, jogging and snapping pictures of the water while officials warned the worst of the storm had not hit.

By evening, a record 13-foot storm surge was threatening Manhattan's southern tip, howling winds had left a crane hanging from a high-rise, and utilities deliberately darkened part of downtown Manhattan to avoid storm damage.

"It's really a complete ghost town now," said Stephen Weisbrot, from a powerless 10th-floor apartment in lower Manhattan.

Water lapped over the seawall in Battery Park City, flooding rail yards, subway tracks, tunnels and roads. Rescue workers floated bright orange rafts down flooded downtown streets, while police officers rolled slowly down the street with loudspeakers telling people to go home.

"Now it's really turning into something," said Brian Damianakes, taking shelter in an ATM vestibule and watching a trash can blow down the street in Battery Park before the storm surge.

Mayor Michael Bloomberg said Monday night that the surge was expected to recede by midnight, after exceeding an original expectation of 11 feet.

We knew that this was going to be a very dangerous storm and the storm has met our expectations," he said. "This is a once-in-a-long-time storm."

Shortly after the massive storm made landfall in southern New Jersey, Consolidated Edison cut power deliberately to about 6,500 customers in downtown Manhattan to avert further damage. Then, huge swaths of the city went dark, losing power to 250,000 customers in Manhattan, Con Ed spokesman Chris Olert said.

New York University's hospital lost backup power, Bloomberg said. Late Monday, a bright orange explosion lit up the night sky on the east side of lower Manhattan, near a Con Ed substation.

"It sounded like the Fourth of July," said Weisbrot.

Another 1 million customers lost power earlier Monday in New York City, the northern suburbs and coastal Long Island, where floodwaters swamped cars, downed trees and put neighborhoods under water.

The storm had only killed one New York City resident by Monday night, a man who died when a tree fell on his home in the Flushing section of Queens.

The rains and howling winds, some believed to reach more than 95 mph, left a crane hanging off a luxury high-rise in midtown Manhattan, causing the evacuation of hundreds from a posh hotel and other buildings. Inspectors were climbing 74 flights of stairs to examine the crane hanging from the $1.5 billion.

The facade of a four-story Manhattan building in the Chelsea neighborhood crumbled and collapsed suddenly, leaving the lights, couches, cabinets and desks inside visible from the street. No one was hurt, although some of the falling debris hit a car.

On coastal Long Island, floodwaters swamped cars, downed trees and put neighborhoods under water as beachfronts and fishing villages bore the brunt of the storm. A police car was lost rescuing 14 people from the popular resort Fire Island.

The city shut all three of its airports, its subways, schools, stock exchanges, Broadway theaters and closed several bridges and tunnels throughout the day as the weather worsened.

Earlier, some New Yorkers defiantly soldiered on, trying to salvage normal routines and refusing to evacuate, as the mayor ordered 375,000 in low-lying areas to do.

Tanja Stewart and her 7-year-old son, Finn, came from their home in Manhattan's TriBeCa neighborhood to admire the white caps on the Hudson, Finn wearing a pair of binoculars around his neck. "I really wanted to see some big waves," he said.

"This is not so bad right now," said the 25-year-old Reilly.

On Long Island, floodwaters had begun to deluge some low-lying towns and nearly 150,000 customers had lost power. Cars floated along the streets of Long Beach and flooding consumed several blocks south of the bay, residents said.

Gov. Andrew Cuomo, holding a news conference on Long Island where the lights flickered and his mike went in and out, said most of the National Guards deployed to the New York City area would go to Long Island.

Anoush Vargas drove with her husband, Michael to the famed Jones Beach Monday morning, only to find it covered by water.

"We have no more beach. It's gone," she said, shaking her head as she watched the waves go under the boardwalk.

Watch What You Say About FEMA

Politicians decry the Federal Emergency Management Agency at their peril. They never know when they might find themselves shamefully explaining away a misstatement or even a snarky remark about the federal disaster assistance agency in the wake of a big storm. Like now.

Republican presidential nominee Mitt Romney suggested last year in a primary debate that the role of states should be strengthened in response to natural disasters, and that the federal role should decrease. ?Every time you have an occasion to take something from the federal government and send it back to the states, that?s the right direction,? he said back then.

Here?s what he?s saying now, through spokeswoman Amanda Henneberg in an e-mail to National Journal. ?States should be in charge of emergency management in responding to storms and other natural disasters in their jurisdictions. As the first responders, states are in the best position to aid affected individuals and communities.?

That?s not very different from what Romney said last year, except that the thought of ?taking away? anything from the federal government is buried. The final sentence of Henneberg?s note answers the question that everyone is asking: ?This includes help from the federal government and FEMA.?

For the record: No, Romney does not favor shuttering FEMA. The only presidential candidate who has made such a suggestion is Rep. Ron Paul, R-Texas. (It?s worth noting that Paul also wants to eliminate the Federal Reserve, the Internal Revenue Service, the Education Department, the Commerce Department, the Energy Department, the Interior Department, and the Office of Housing and Urban Development.)

What Romney is describing is basically what?s happening now. FEMA exists solely to support states and cities that need help preparing for and recovering from storms, floods, or tornados. It does not take on that coordinating role in states unless they are invited by a governor who has declared a state of emergency. In effect, FEMA now functions as a big checkbook. It provides money to states and cities that need resources to evacuate people, set up shelters, or sandbag. It also directs money to those areas after a storm to help local areas rebuild and clean up.

President Obama and Romney may disagree vehemently over health care and abortion, but they are in pretty close agreement about how federal disaster aid should work, given their comments about Hurricane Sandy. Both want the states and local officials to run the show. They both say everyone needs to cooperate.

?There's been extraordinarily close coordination between state, federal, and local governments. And so we?re confident that the assets are prepositioned for an effective response in the aftermath of the storm,? Obama said from the Oval Office on Monday. Romney, in solidarity with the effort, cancelled all his campaign events.

The appropriate balance between state and federal resources devoted to disaster response is an ongoing (and nonpartisan) question. States with the best preparation can direct their emergency activities toward the greatest needs, with or without FEMA?s help. States that aren?t as well set up have difficulty responding to a natural disaster no matter what FEMA does. Emergency officials in both the Obama and Bush administrations have struggled with this balance, especially when states are facing budget crunches.

?FEMA is only as good as the state it works in,? said Daniel Craig, who ran the recovery division of FEMA in the Bush administration and now runs his own disaster recovery firm, Tidal Basin Government Consulting. ?The states are in charge. If a state can handle it, they handle it. And if it?s beyond their ability to handle it, they ask the government to come in.?

If Romney were to become president, would anything change? It?s hard to know based on his comments, but Craig offers a hint. ?A strong FEMA makes states weak,? he said. ?This is my personal view, but if the federal government is strong, the states start to rely on the federal government.??

If FEMA is seen by states as a default provider of aid, the federal agency can become strained with too many requests for help. Hurricane Sandy is a perfect example. The storm had the potential to affect states up and down the Eastern Seaboard. Where does FEMA go? Atlantic City or Alexandria, Va.? What if the storm didn?t land there? ?You don?t want to follow the storm,? Craig said.

Because FEMA doesn?t do anything in the affected areas without consulting with local officials, the state, local, and federal relationship should be almost seamless. Fortunately, emergency officials at all levels of government are used to working closely with one another.

Emergency response is not a political issue. FEMA and state emergency officials are like one big family. Craig is close friends with the current FEMA director Craig Fugate, for example. He knows the state emergency directors from many of the Northeast and Atlantic states. He says that although the hours and challenges of working at FEMA are brutal?particularly on families?he would go back to FEMA in a heartbeat.

?FEMA has a critical mission, and the people do an unbelievable job. People are working over there 24/7 and nobody sees it. The state governments are the same way,? Craig said.

That sounds a lot like the way both Romney and Obama view the agency, which means there likely won?t be much change to FEMA no matter who wins the election.

Feds likely to manage Maine's health insurance exchange ...

AUGUSTA, Maine ? The Affordable Care Act set a Nov. 16 deadline for states to declare whether they intend to establish their own health insurance exchange. It?s a key provision of the act, one that is intended to provide affordable insurance to uninsured individuals and small-business employees starting Jan. 1, 2014.

While Maine has not formally announced its intention, it is so far behind in preparing its own exchange that the federal model will likely be adopted by default.

When asked for confirmation that Gov. Paul LePage won?t be pursuing a state-run exchange, his press secretary, Adrienne Bennett, told Mainebiz she had nothing to report on the subject and that the state ?is currently assessing options.?

But Mitchell Stein, policy director for the Augusta-based Consumers for Affordable Health Care, says even if LePage declares in the next month that Maine intends to create a state-run exchange, that?s only one step in the process.

The federal government has a 27-page checklist of steps that must be followed in order for a state to be certified as being on track to meet the ACA?s October 2013 enrollment period and the Jan. 1, 2014, opening of the exchange. And on that front, Stein says, Maine will have a tough job convincing the federal government it will be ready to open its own exchange a little more than a year from now ? given that LePage, in an April 18 letter, informed the federal Department of Health and Human Services he was turning back a $5.8 million grant that was to help pay for many of the federal government?s set-up requirements.

?There?s a tremendous amount of work to be done,? Stein says, citing as one example the required integration of the exchange?s eligibility systems with existing Medicaid eligibility systems to ensure a low-income enrollee who?s eligible for Medicaid gets referred to that program instead.

Other requirements include:

? Making sure the exchange has a seamless enrollment system that?s able to handle in-person, phone or online applications with equity.

? Having the ability to interface with the Internal Revenue Service to ensure that applicants meet the ACA?s income guidelines for enrolling in a health insurance exchange.

? Providing ?apples-to-apples? comparisons between different insurance policies available through the exchange so that consumers can make informed choices.

Stein acknowledges meeting all the requirements of setting up a state-run health insurance exchange involves costs that in a tough economy might be regarded as unaffordable. ?Much of it would have been paid by federal grants? included in the ACA?s enabling legislation, he says.

Getting ready, or not

According to the 2010 U.S. Census, 125,600 Mainers are uninsured, or roughly 10 percent of the population.

Exchanges are expected to provide competitive marketplaces in which the uninsured can directly compare and purchase private health insurance options that meet their needs. The idea is that, pooled together, their numbers will be large enough to gain coverage that individually would be too expensive to buy. For certain low- and moderate-income uninsured people, the federal government will provide subsidies to make such coverage more affordable, or in some cases, they could be referred to Medicaid for coverage.

In a Sept. 27 status report, the Kaiser Family Foundation identifies Maine as one of eight states already serving notice to the federal government that they won?t be pursuing a state-based health insurance exchange ? the others being Alaska, Florida, Louisiana, South Carolina, Texas, South Dakota and New Hampshire. Kaiser says that number could grow, since 16 states are still studying their options and eight others have not shown any significant activity moving in the direction of creating a state-run exchange.

As CAHC?s policy director, Stein says he attended hearings in the last legislative session on two competing bills to create a state-run exchange. In their initial versions, he says, both LD 1498, favored by Democrats, and the Republicans? LD 1497, agreed on having Maine establish and operate its own exchange. In the end, a watered-down version of LD 1497 was adopted, stating that only licensed insurance brokers can enroll people in health plans through an exchange.

Even if Maine opts out and the state ends up with a federally run exchange on Jan. 1, 2014, Stein says the state will have yearly opportunities to apply for approval of a state-run exchange down the road. Likewise, he says, the next Legislature could very well resurrect elements of the two failed bills calling for a state-run exchange.

Stein says the obvious downside of having the federal government run Maine?s exchange is that it removes local control and flexibility over how the program is set up and run. A potential plus, he says, is that it would likely fall somewhere in the middle of what he characterizes as the ?passive? pro-insurance industry focus of the initial version of the GOP?s LD 1497 and the ?active? pro-consumer emphasis of the Democrats? LD 1498.

?There are a lot of moving pieces here and some of the moving pieces haven?t been determined yet,? he says.

The Not-so-spooky Presidio Pet Cemetery - Hidden Histories ...

Welcome to Curbed's ongoing series titled Hidden History, where Curbed highlights a Bay Area location with a secret past. Maybe it's no longer there, maybe it's been converted into something else, but each spot holds a place in Bay Area history - even if not many people know it. Just in time for Halloween, this week's Hidden History focuses on the spooky ghostly world of cemeteries. But not just any ole eternal resting place - the Presidio Pet Cemetery.

The final resting place for hundreds of animals owned by families that were stationed at the Presidio, the pet cemetery dates back to the 1950's. According to the National Park Service, there are no official records for the site, meaning it probably sprung up from the families themselves with authorization from one of the commanding officers. There are legends of previous incarnations of the cemetery, which some believe was originally a burial ground for nineteenth-century cavalry horses or World War II guard dogs.

The grave markers feature some heart-wrenching and historic details on the beloved pets, including their birthplace (like Patches the Cat born in Dachau), family names and owners' ranks, including majors, colonels, and generals. Some look like official military tombstones, due to Presidio Boy Scout volunteers who replaced crumbling markers sometime in the late 1980s or early 90s.

When the Presidio was in process of becoming a National Park, one (heartless?) congressman against the NPS conversion used the pet cemetery as fodder, sending letters to his supporters with a photo of the pet cemetery and the headline asking "Is This Your Vision of a National Park?" Apparently it was, because the Presidio became part of the Golden Gate National Recreation Area in 1994 (though the cemetery is not included in the official National Historic Landmark district).

Today the cemetery is officially closed to new burials, but since it isn't patrolled, people still sneak in to bury their pets. When the Doyle Drive project began a few years ago, the pet cemetery was designated an "environmentally sensitive area," so it was protected from construction.

Commercial medical tapes on the market today are great at keeping medical devices attached to the skin, but often can do damage?such as skin tissue tearing?once it's time to remove them.

A research team from Brigham and Women's Hospital (BWH) has invented a quick-release tape that has the strong adhesion properties of commercial medical tape, but without the ouch factor upon removal.

The team was led by Jeffrey Karp, PhD, BWH Division of Biomedical Engineering, Department of Medicine, senior study author in collaboration with The Institute for Pediatric Innovation which defined the need and requirements for a new neonatal adhesive based on national surveys of neonatal clinicians.

The study detailing the tape design will be electronically published on October 29, 2012 in the Proceedings of the National Academy of Sciences. The research was conducted in collaboration with Robert Langer, PhD at the Massachusetts Institute of Technology.

The tape which achieves strong adhesion when securing medical devices to skin, but could also easily peel off safely, utilizes a three-layer design approach that sets a new paradigm for quick-release medical tapes.

"Current adhesive tapes that contain backing and adhesive layers are tailored to fracture at the adhesive-skin interface. With adults the adhesive fails leaving small remnants of adhesive on the skin while with fragile neonate skin, the fracture is more likely to occur in the skin causing significant damage," said Karp. "Our approach transitions the fracture zone away from the skin to the adhesive-backing interface thus completely preventing any harm during removal."

The approach incorporates an anisotropic adhesive interface between the backing and adhesive layers. The anisotropic properties of this middle layer means that it has different physical properties dependent on direction. For instance, take wood, which is stronger along the grain than across it.

The researchers employed laser etching and a release liner to create the anisotropic interface resulting in a medical tape with high shear strength (for strong adhesion) and low peel force (for safe, quick removal). Once the backing is peeled off, any remaining adhesive left on the skin can safely be rolled off with a finger using a "push and roll" technique.

"This is one of the biggest problems faced in the neonate units, where the patients are helpless and repeatedly wrapped in medical tapes designed for adult skin," said Bryan Laulicht, PhD, BWH Division of Biomedical Engineering, Department of Medicine, lead study author.

There are more than 1.5 million injuries each year in the United States caused by medical tape removal. Such injuries in babies and the elderly?populations with fragile skin?can range from skin irritation to permanent scarring.

Gunmen kill religious leader in Russia's Dagestan

MOSCOW (Reuters) - Gunmen shot dead a Muslim religious leader in Russia's Dagestan region on Tuesday in an attack likely to worsen a spiral of militant violence that threatens Moscow's hold on the restive North Caucasus.

Karimulla Ibragimov was at least the fifth Muslim leader killed this year in Dagestan following a rise in tension between moderate and more radical Muslims in the southern Russian republic.

Unidentified gunmen opened fire on Ibragimov in the town of Derbent at around 6:30 a.m (0230 GMT), Russia's Investigative Committee said. Local officials said he had served as an imam at an unregistered mosque frequented by radical Muslims.

"All three died on the spot from the gunshot wounds," the committee, a government agency that handles criminal investigations, said in a statement.

Russian news agencies said the gunmen escaped in a car.

Dagestan is at the centre of an insurgency for an Islamic state in the North Caucasus, more than a decade after Russian troops ousted a rebel government in neighboring Chechnya and restored Moscow's direct control.

Security analysts said the violence could be aimed at spoiling efforts to reconcile moderate and more extremist Muslims, and provoke a more forceful approach by Moscow which could further radicalize the population.

President Vladimir Putin, who as prime minister in 1999 sent troops to Chechnya, has made clear he favors a tough approach and will not let religious intolerance tear Russia apart.

Russia's most senior Islamic cleric warned in August that there was a danger of civil war in Dagestan, which is only a few hundred kilometers (miles) from the city of Sochi where Russia will host the 2014 Winter Olympics.

Putin has called for unity and has told security forces to outsmart and outmuscle Islamist militants to ensure the safety of the Winter Games and other events Russia is hosting.

CONCERNS OVER EXTREMISM

In comments published on Tuesday, the head of the Dagestan region, Magomedsalam Magomedov, echoed Putin's remarks and pleaded for an end to violence.

"We should act against extremism and terrorism with one front, work more actively, aggressively and in a more targeted way," he was quoted by Itar-Tass news agency as telling a regional anti-terrorism commission.

Efforts to reconcile adherents to the mystical Sufi branch of Islam and Muslims who practice the purist Salafi version of the faith were launched after Putin steered his ally Dmitry Medvedev into the presidency in 2008.

But security analysts say that renewed violence in Dagestan could force a more robust approach toward religious intolerance which could backfire by encouraging retaliation and fuelling bloodshed.

"(Today's attack) could be used as one more argument for the increased use of force," said Grigory Shvedov, editor of web news portal Caucasian Knot www.kavkaz-uzel.ru.

"If this approach is implemented, then the violence will definitely increase a lot," he said.

In August, a woman disguised as a pilgrim detonated a bomb strapped to her body in Dagestan, killing popular spiritual leader Said Atsayev, 74, an opponent of militant Islam.

Suicide bombers and gunmen have killed at least three other religious leaders in Dagestan this year, including another Salafi leader earlier this month.

In July, the top Muslim official in Tatarstan - about 2,000 km (1,240 miles) from the North Caucasus - was wounded in a car-bomb attack and his deputy was shot dead the same day.

The attacks raised concerns in Moscow that militant violence could spread to Russia's heartland and Putin flew to Tatarstan to appeal for calm.

The attacks have largely been depicted by religious experts as retribution for the authorities' crackdown on Salafism, which along with corruption and clan feuds, has been instrumental in directing young Muslims into the ranks of the insurgency.

Energy markets rise on Sandy, insurers fall

NEW YORK (Reuters) - U.S. gasoline and heating oil futures gained while U.S. Treasuries also rose on Monday, as economic worries over Hurricane Sandy fuelled safe-haven buying in thin trading as the powerful storm began to batter the U.S. East Coast.

The storm closed Wall Street on the anniversary of the 1929 stock market crash. It was the stock market's first weather-related closure in 27 years, and other markets closed early as investors braced for the impact of Sandy, one of the biggest storms ever to slam the U.S. eastern seaboard.

U.S. stock and bond markets will be closed on Tuesday, but the two-largest U.S. stock exchange operators, NYSE Euronext and Nasdaq OMX Group, intend to reopen Wednesday, conditions permitting.

Trading was thin in U.S. foreign exchange, fixed income, precious metals and energy markets as public transportation was shut in New York and parts of lower Manhattan were evacuated.

"You have uncertainties now. You have these safe haven purchases. People are trying to figure out the economic impact from the storm," said Larry Milstein, head of government and agency trading at R.W. Pressprich & Co in New York.

"Right now it's the easy way to buy Treasuries and wait to see what happens," Milstein said.

Benchmark U.S. 10-year Treasury notes traded 8/32 higher in price to yield 1.7206 percent.

U.S. heating oil futures gained, touching the highest level relative to U.S. crude oil on record, as dealers hedged against the risk of power outages and flooding from Sandy that could damage refineries and keep production shut for weeks.

The crack spread, the difference in value between a barrel heating oil and a barrel of crude oil, touched $45.15 a barrel.

"Markets will be watching for reports of damage to energy infrastructure, notably refineries, post-Sandy, given the state of extremely low gasoil inventories as we move into winter season," Deutsche Bank analysts said.

Gasoline futures reached $2.8115 a gallon, the highest since October 17, before paring gains as traders factored in the reduced demand for fuel with the almost total shut-down of eastern seaboard roads and airports.

In Europe stocks, led by insurers, fell on expectations Sandy-related damage will boost claims, while political jitters in debt-laden Italy cast shadows on the euro zone.

Reinsurers Swiss Re and Hannover RE led a weaker European insurance sector index as the market tried to foresee the clean-up costs of Sandy.

"We are seeing insurers slide and we've sold a bit of Aviva and RSA," said Ed Woolfitt, head of trading at Galvan Research.

Euro zone blue chips shed 0.7 percent to 2,478.84 points after former Prime Minister Silvio Berlusconi threatened to bring down the government of his successor, Mario Monti, which has appeased markets with its austerity agenda.

The broader MSCI world equity index lost 0.26 percent to 327.74 points - on track for its worst monthly performance since May as doubts grow over the effect of the latest round of central bank efforts to boost activity.

The euro fell against the dollar and yen, hurt by uncertainty over whether Greece can agree to a deal on austerity and with no sign of when Spain might request aid.

The single currency was expected to stay subdued against the dollar and the yen, with investors preferring safe-haven currencies on renewed worries about weak earnings from top companies in the region.

The single currency was down 0.3 percent at $1.2898, not far from a two-week low of $1.2881.

The dollar rose to a session high against the yen ahead of a Bank of Japan policy review on Tuesday at which the central bank is expected to further ease monetary policy.

The dollar was last up 0.2 percent at 79.80, the session peak.

U.S. consumer spending rose solidly in September, putting the economy on a firmer footing heading into the fourth quarter even though households had to pull back on saving to fund purchases.

But the rise in consumer spending will mask a pullback late in the year as businesses hold investments in anticipation of higher taxes and cuts in federal spending that will kick in beginning early next year if Congress doesn't act, said Ellen Zentner, senior U.S. economist at Nomura Securities in New York.

Positive surprises, including third-quarter U.S. growth data and signs of stabilization in China, have failed to persuade investors that the world economy can achieve lasting growth as multinational global companies have forecast weak revenues.

WOW! It?is very windy down here at the Jersey Shore!? It actually was a good workout because while walking into wind, there was some real Resistance Training (the other RT, non-negotiable in my programs) going on!

I just posted information about how important it is to have rituals; not so much goals, when it comes to our mind, body and spirit activities and behavior changes we want to make.? PangPang and I headed out for our Ritual Trekking (RT) earlier today.? I, as always, am in a fasted-state during our Ritual Trek.? I hope to post the food I ate when we returned later.? The Jersey Shore is in a direct path of the FRANKENSTORM (Hurricane Sandy), coming tomorrow night, hitting land.

But this is what a ritual is? doing it regardless, because you just do it.? When you absolutely can?t do it? it bothers you? like not being able to brush your teeth.? We did the best we could with our ritual trek?

Here?s what I had upon return home?

I made a burrito with dark meat chicken, refried beans, seasoning, wrapped in iceberg lettuce and top with Trader Joe?s bean salsa, full fat sour cream and topped with freshly ground flax and chia seeds.? I couldn?t even finish it!

Exercising in a ?fasted-state? (not too hard/long, BUT hard OR long)? you?re a little hungry, but once you start eating, even a yummy dish like this? you cant? finish it. I ate about 3/4 of it. Eating slowly helps too! Grains and large portions make you fat and insulin resistant NOT naturally ocurring fat in food. Fat makes it tasty.

Monday Oct 29, 2012 (foodconsumer.org) --Andy H. Lee at School of Public Health, Curtin University in Perth, WA, Australia ?and colleagues reported a study in Cancer Epidemiology suggesting that drinking tea may cut risk of ovarian cancer.

The researchers compared 500 incident cases of varian cancer with 500 controls, both groups of Chinese women at a mean age of 59 years for tea consumption and found that after adjustment for potential confounders, women who drank green, black and or oolong teas were about 70 percent less likely to be diagnosed with ovarian cancer, compared to those who did not drink.

The subjects for the study were recruited from ?four public hospitals in Guangzhou, China and dietary information on tea drinking was collected through a questionnaire.

The researchers found women without ovarian cancer were found more likely more often to drink more tea than those who were diagnosed with the disease, 78.8% versus 51.4%.

The association between tea drinking and risk of ovarian cancer was affected by the duration of drinking, the number of cups and quantity of tea consumed and the amount of dried tea leaves brewed.

The researchers concluded "Regular tea consumption is associated with a reduced risk of ovarian cancer for southern Chinese women."

We can?t help but smile when we see them opening the huge box full of blue balloons? seriously, this is just the cutest idea ever! Guests enjoyed OneHope Wine, visited different activity stations and soaked up some sun? it was the perfect day for a baby shower!
